1. General Provisions

These General Terms and Conditions (GTC) apply to all orders and purchase contracts concluded via the KSCU.shop – King Sunshine Crypto Universe online shop.

Validity of the GTC

By placing an order, these General Terms and Conditions in their version valid at the time of the order become part of the purchase contract. The current version of these GTC is always available on the website. Changes do not apply retroactively to contracts already concluded. Deviating terms and conditions of the buyer are only valid if the seller has expressly agreed to their application in writing.  

Contract Language

The online shop is available in German and English. In case of discrepancies between the language versions or in case of interpretation questions, only the German version is decisive.

Delivery Countries 

Orders are only possible in those countries that can be selected as delivery countries during the ordering process. An overview of the currently available shipping countries and any delivery restrictions can be found on our Shipping page.

Note on Readability

For reasons of better readability, the term "buyer" is used in these GTC. It refers equally to people of all genders.

Product Representation and Technically Induced Deviations

Product images are for illustration purposes. Slight color deviations between the screen display and the actual product can occur, in particular due to different screen settings and the printing process used. Such technically induced deviations do not constitute a defect, provided that the goods as a whole correspond to the product description.

Relationship with Shopify

The KSCU.shop online shop is operated via the Shopify e-commerce platform. Shopify provides the technical infrastructure for the operation of the online shop. The contractual partner of the buyer for all purchases concluded via KSCU.shop is exclusively the seller named in these GTC. Shopify is not the seller of the goods offered and not a contractual partner of the respective purchase contract.



2. Conclusion of Contract

The presentation of the products in the online shop does not constitute a legally binding offer, but an non-binding invitation to place an order.

Before submitting the order, the buyer has the opportunity to check and correct all entered data. Input errors can be corrected using the editing functions provided in the ordering process.

By submitting the order and activating the "Order with obligation to pay" button (or an equivalent unambiguous wording), the buyer makes a binding offer to conclude a purchase contract. The purchase contract is concluded with the dispatch of the order confirmation by e-mail.

Obvious spelling, calculation or display errors as well as technically caused incorrect information in the online shop can be corrected. Statutory rights of the buyer as well as already effectively concluded contracts remain unaffected.

 


3. Prices and Payment Methods

The prices displayed in the online shop apply in the currency selected or available for the country of delivery. Due to the application of the European small business regulation, no sales tax is shown. The total price relevant for the order will be displayed to the buyer in the checkout before the order is completed.

In addition to the price of the goods, shipping costs apply. An overview of shipping costs and shipping conditions is available on our shipping page. The shipping costs incurred for the specific order will be shown separately in the checkout before the order is completed.

Payment is made using the payment methods offered in the checkout. Which payment methods are available may depend in particular on the country of delivery, the currency used, the end device and the availability of the respective payment service provider.

Payment processing is carried out by the respective selected payment service provider. Its terms and conditions and data protection provisions may also apply.

For deliveries outside the European Union, additional import duties, customs duties or taxes may apply and are not included in the total price. These are to be borne by the buyer and are based on the legal provisions of the respective destination country.


4. Production, Shipping & Delivery

All products are individually produced only after an order is received (print-on-demand). This avoids overproduction and conserves resources. Production begins after successful order and payment confirmation.

Should there be delays in production or delivery due to unforeseeable events, force majeure or other circumstances beyond our control, we will inform the buyer accordingly. 

Delivery will be made to the delivery address provided by the buyer during the order process. The buyer is responsible for ensuring that the delivery details provided are complete and correct. If additional shipping or processing costs arise due to incorrect or incomplete address details, these may be charged to the buyer. 


5. Retention of Title

The delivered goods remain the property of the seller until full payment of the purchase price.


6. Right of Withdrawal

Consumers generally have a statutory right of withdrawal of 14 days for distance contracts. The withdrawal period begins on the day on which the buyer or a third party designated by him, who is not the carrier, has taken possession of the goods.

To exercise the right of withdrawal, the buyer can use the statutory withdrawal button provided on our website or declare the withdrawal to the seller by means of a clear statement (e.g. by e-mail). The declaration is not bound to any particular form.

The withdrawal period is met if the declaration of withdrawal is sent before the expiry of the period. In the event of an effective withdrawal, all payments made by the buyer, including the costs of standard delivery, will be refunded within 14 days from receipt of the declaration of withdrawal.

The seller may refuse repayment until the goods have been returned to the seller or the buyer has provided proof that the goods have been sent back - whichever is the earlier date.

The refund will be made using the same payment method that the buyer used for the original transaction, unless expressly agreed otherwise.

7. Returns

Returns may be necessary in connection with a withdrawal, a complaint, transport damage or a warranty claim.

The seller must be contacted before any return. The goods may only be shipped after the return address valid for the respective return case has been provided. The return address may differ from the business address of the seller.

In the event of a withdrawal, the goods must be returned immediately, but no later than within 14 days from the declaration of withdrawal. The deadline is met if the goods are sent before the expiry of this period. The buyer bears the direct costs of the return.

In the event of a complaint, transport damage or a warranty claim, the further procedure and any necessary return will be coordinated with the buyer after examination of the respective case.

The goods must be packed securely for transport. For returns, it is recommended to use a shipping method with tracking and to keep the shipping receipt until the processing is completed. Repayment may be refused until the goods have been received or the buyer has provided proof of return. If the return is lost and no corresponding shipping receipt is available, no repayment will be made.


8. Warranty

The statutory warranty provisions apply to the goods offered. The warranty period is two years from the handover of the goods.

A defect exists in particular if the goods are damaged upon handover, do not correspond to the product description or have a faulty print.

Normal wear and tear as well as damage caused by improper use, incorrect care or non-observance of the product and care instructions are not covered by the warranty.

For the examination and processing of a defect, meaningful photos of the goods and the complained area are required. If an assessment based on the photos is not possible, a return of the goods may be necessary after prior consultation.


9. Complaints (incl. Transport Damage)

Obvious transport damage or production defects must be reported within seven days of receipt of the goods. Damages reported later may under certain circumstances no longer be considered if an examination by the fulfillment partner or the shipping service provider is made more difficult or impossible due to the delayed report. The statutory warranty rights of the buyer remain unaffected.

Complaints must be sent by e-mail to office(at)kscu.shop and must contain the following information:

  • Invoice number
  • Name and email address of the buyer
  • Description of the defect or damage
  • Meaningful photos of the entire goods and the complained area
  • In case of transport damage, also photos of the outer and inner packaging and the shipping label

After receipt of the complaint, the case will be examined. The type of further processing depends on the respective complaint case.

If a return is necessary, the buyer will be informed separately about the further procedure and the valid return address. The goods may not be returned independently and not without prior consultation.

In the event of externally recognizable transport damage, the condition of the shipment should be documented as far as possible already upon delivery and, if possible, confirmed by the delivery person.


10. Liability

The seller is liable according to the statutory provisions.

The seller is not liable for damages resulting from improper use of the goods or from non-observance of the product, safety or care instructions, unless the seller is responsible for the damage.

Liability under the Product Liability Act as well as liability for personal injury remain unaffected.


11. Logos and License Notices

Insofar as logos or trademarks of cryptocurrencies or other projects are used for a product, the terms of use and license provisions listed on the respective product page in the "License Notice" section apply.

The purchase of a product does not transfer any copyrights or rights of use to the logos or trademarks used thereon.


12. Data Protection

Personal data is processed in compliance with the applicable data protection regulations. Detailed information about the nature, scope and purpose of data processing, the service providers used and the rights of affected persons can be found in the privacy policy of the online shop.


13. Final Provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not restrict mandatory statutory provisions of the state in which the consumer has his habitual residence.

The statutory venues apply for disputes. No deviating venue is agreed with consumers.

Should individual provisions of these GTC be or become invalid, the remaining provisions remain unaffected. The statutory provisions shall take the place of the invalid provision.
